Terms of Service

Please read these Terms of Service carefully before using WebMap. By accessing or using WebMap, you agree to be bound by these terms. If you do not agree, do not use the service.
1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and High Country Digital (ABN 90 684 626 237) ("we", "us", or "our"), the operator of WebMap, accessible at getwebmap.com ("Service").
By creating an account, accessing the Service, or permitting any person to use the Service on your behalf, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you are entering into these Terms on behalf of a business or other legal entity, you represent that you have authority to bind that entity.
2. Description of Service
WebMap is a software-as-a-service platform designed for web design and digital agencies. It enables agencies to collect structured design feedback from their clients through a guided, multi-step process that includes visual website annotation, site page planning, asset uploading, and the generation of an AI-powered design brief.
The Service includes the following features: shareable client project links (no client account required), iframe-based and screenshot-based website annotation, AI-generated design briefs, in-app messaging between agency and client, project progress tracking, image uploading and management, and PDF brief export.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with reasonable notice where practicable.
3. Accounts and Registration
Agency access to the Service requires registration with a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at support@hcdigital.com.au if you suspect any unauthorised use of your account.
Client access is provided via a unique share link generated by the agency. Clients are not required to create an account. When using a share link, the client confirms they have been authorised by the agency to submit content in connection with the relevant project.
You must provide accurate and complete information when registering and keep your account information up to date. Accounts may not be transferred or shared between individuals without our prior written consent.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in a manner consistent with these Terms. You must not:
- Use the Service to scrape, harvest, or systematically collect data from third-party websites beyond the legitimate annotation and briefing workflow the Service is designed to facilitate.
- Abuse, circumvent, or attempt to circumvent usage limits, AI generation quotas, or subscription restrictions.
- Upload or transmit malicious code, viruses, harmful files, or any content that could damage the Service or other users' systems.
- Upload content that is unlawful, defamatory, obscene, infringing of third-party intellectual property rights, or otherwise objectionable.
- Use the Service to harass, abuse, or harm any person.
- Attempt to gain unauthorised access to any part of the Service, other user accounts, or related systems.
- Reverse engineer, decompile, or disassemble any part of the Service.
- Resell, sublicense, or otherwise commercialise access to the Service without our prior written consent.
- Use automated tools (bots, scrapers, crawlers) to access or interact with the Service except as explicitly permitted by us in writing.
We reserve the right to suspend or terminate accounts that violate these acceptable use provisions without prior notice.
5. Intellectual Property
Your content: You and your clients retain full ownership of all content you submit to the Service, including images, text, website URLs, annotations, page plans, and uploaded assets ("Your Content"). You grant us a limited, non-exclusive, royalty-free licence to host, store, transmit, and process Your Content solely for the purpose of providing and improving the Service.
AI-generated output: Design briefs, website analyses, and other AI-generated content produced by the Service using Your Content are provided for your use as part of the Service. You may use this output for your agency's commercial purposes (including sharing with clients and informing design decisions), subject to the disclaimer in Section 6 below. We do not claim ownership of AI-generated output produced from Your Content.
Service IP: The WebMap platform, software, design, trademarks, and all content we create remain the exclusive intellectual property of High Country Digital. Nothing in these Terms grants you any right to use our trademarks, trade names, or branding.
6. AI-Generated Content Disclaimer
The design briefs, site structure suggestions, content recommendations, and other AI-generated outputs produced by the Service are provided as suggestions only. They are based on the input data provided and are generated by third-party AI models.
AI-generated content may contain errors, omissions, inaccuracies, or recommendations that are not appropriate for a particular project. Before acting on any AI-generated output — including sharing it with clients, incorporating it into designs, or using it as the basis for commercial decisions — you should review and verify the content for accuracy, relevance, and suitability.
We make no representations or warranties regarding the accuracy, completeness, or fitness for purpose of any AI-generated content. Your use of AI-generated output is entirely at your own discretion and risk.
7. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy explains how we collect, use, and store personal information in connection with the Service.
You are responsible for ensuring that any personal information you submit on behalf of your clients (including their name, email address, and website data) is collected and shared with us in compliance with applicable Australian privacy laws, including the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
8. Payment Terms
Access to the Service is provided on a subscription basis. Current pricing plans and fees are published on the WebMap website at getwebmap.com. All prices are in Australian dollars (AUD) and include GST where applicable.
Subscription fees are billed in advance on a monthly or annual basis, depending on the plan selected. Payment is processed securely by our third-party payment processor. We do not store your full payment card details.
Fees are non-refundable except as required by Australian Consumer Law or as otherwise stated in these Terms. If you cancel your subscription, you will retain access to the Service until the end of your current billing period. No partial refunds are issued for unused periods.
We reserve the right to change our pricing with at least 30 days' notice. Continued use of the Service after a price change takes effect constitutes your acceptance of the new pricing.
9. Service Availability
We aim to provide a reliable, high-quality service, but we do not guarantee uninterrupted or error-free access. The Service is provided on a best-efforts basis. We do not offer any formal service level agreement (SLA) or uptime guarantee.
We may perform scheduled or emergency maintenance that temporarily interrupts access to the Service. We will attempt to provide reasonable advance notice of planned downtime where practicable.
The availability and quality of certain Service features (including iframe-based website rendering and AI brief generation) may be affected by the behaviour of third-party websites and services outside our control.
10. Limitation of Liability
To the maximum extent permitted by law, High Country Digital and its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service, including loss of profits, loss of data, business interruption, or reputational damage, even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for any claim arising under or in connection with these Terms or your use of the Service will not exceed the total amount you paid us in the three (3) months immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded or limited.
11. Termination
You may cancel your subscription and close your account at any time by contacting us at support@hcdigital.com.au. Cancellation takes effect at the end of your current billing period. You will retain access to the Service until that date.
We may suspend or terminate your account immediately if you breach these Terms, engage in fraudulent activity, fail to pay applicable fees, or if continued access poses a risk to the Service or other users.
Upon termination or cancellation, your access to the Service will cease. Your project data — including annotations, briefs, uploaded images, and messages — will be retained for 30 days following the effective date of termination, after which it will be permanently deleted. You are responsible for exporting any data you wish to retain (for example, by downloading briefs as PDFs) before your account is closed.
12. Changes to Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. For material changes, we will provide notice via email or through the Service at least 14 days before the changes take effect.
Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the Service and cancel your account.
13. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of Victoria, Australia. You irrevocably submit to the non-exclusive jurisdiction of the courts of Victoria and the Federal Court of Australia for the resolution of any dispute arising under or in connection with these Terms.
For users in the United States:
To the extent permitted by applicable law, any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA), rather than in court. You agree to waive your right to a jury trial and to participate in a class action lawsuit or class-wide arbitration. Nothing in these Terms limits your rights under applicable US consumer protection laws, including the California Consumer Privacy Act (CCPA) where applicable.
For users in Canada:
These Terms are subject to all applicable federal and provincial laws of Canada. If you are a resident of a Canadian province, you may have additional rights under provincial consumer protection legislation that cannot be waived. Nothing in these Terms excludes or limits any mandatory consumer rights under the Consumer Protection Act (Ontario), the Consumer Protection Act (Quebec), or equivalent provincial legislation. Canadian users may bring claims in the courts of their province of residence. Personal information is handled in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy legislation.
